Vendor Terms and Conditions

Welcome to YABOOKA Marketplace. These Vendor Terms and Conditions (“Agreement”) govern your relationship with us. By registering as a vendor and using our platform, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Registration and Eligibility

  • To become a vendor on YABOOKA, you must complete the registration process, providing accurate and complete information.
  • You must be at least 18 years old and legally capable of entering into contracts.

2. Vendor Responsibilities

  • You are responsible for maintaining the confidentiality of your account information, including your password.
  • You agree to comply with all applicable laws and regulations when selling products on the platform.
  • You must ensure that all product listings are accurate, up-to-date, and comply with our listing guidelines.

3. Product Listings and Pricing

  • All product descriptions, images, and prices must be accurate and not misleading.
  • You agree to honor the prices and terms stated in your product listings.
  • We reserve the right to remove or modify any listings that violate our policies or applicable laws.

4. Commissions and Fees

  • A flat 10% commission will be deducted from the sale price of each product sold through the platform.
  • All commissions and fees are non-refundable.

5. Payment, Payouts, and Withdrawal Fees

  • Payments for orders will be processed soon after the order is completed.
  • Payouts will be made in either Malawian Kwacha (MWK) or United States Dollars (USD), based on your chosen preference.
  • A 4% withdrawal fee will be applied to all withdrawal requests, which will be deducted from your payout before disbursement.

6. Shipping and Fulfillment

  • You are responsible for shipping products to customers within 2 business days after payment is received.
  • Shipping must be done through the Post Office or Speed courier services as specified.
  • You must provide customers with a clear receipt that includes a stamp, confirming the shipment.
  • Local pickups are not allowed.

7. Refunds, Returns, and Cancellations

  • You must process refund requests within 10 days of receiving them.
  • You agree to comply with our cancellation, return, and exchange policies.
  • All refunds and exchanges must be processed through the platform, and no direct refunds are allowed.

8. Termination of Account

  • We reserve the right to terminate your vendor account for any violation of this Agreement or any applicable laws.
  • Upon termination, you will no longer have access to the platform or your vendor account, and all pending orders will be processed according to our policies.

9. Limitation of Liability

  • YABOOKA will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.
  • Our total liability for any claim arising out of this Agreement will not exceed the total commissions earned from your sales.

10. Modifications to the Agreement

  • We reserve the right to modify this Agreement at any time. Changes will be effective upon posting on the platform, and you will be notified via email.
  • Your continued use of the platform after any changes constitutes your acceptance of the new terms.

11. Governing Law

  • This Agreement will be governed by and construed in accordance with the laws of Malawi, without regard to its conflict of law provisions.
